CIRUM provides expertise for the supervision of land and forest allocation
- According to Official Letter 324 / HDDT14 dated August 9, 2017 by National Assembly’s Ethnic Council on support to supervise the implementation of policies and legislation on land and forest allocation (land rights) to households and communities in ethnic minority, mountainous areas for Forestry Law Revision, CIRUM has been invited as expert to involve in the mission. These supervisions are conducted in the nine provinces of Lao Cai, Lai Chau, Dien Bien, Hoa Binh, Nghe An, Quang Nam, Quang Ngai, Gia Lai and Dak Nong.
The supervisory missions have assessed the situation, the results of forest land allocation in localities, and identified the remaining issues, such as local people’s shortage of land and forests, while forest land is still temporarily managed by communal people's committee and land has not been allocated to households and communities as planned. Due to the lack of land, it is difficult for local people to promote production to escape poverty, so there exists encroachment of the forest for cultivation. Besides, some local authorities have allocated land and forest to individuals and households, but that does not suit the customary management and protection of ethnic minority communities.
Supervisory delegations and related local officers have proposed amendments to the law to secure ownership of forests for local people and communities; simplification of forest allocation procedures for communities and households, adjustment of the benefit sharing regime for forest protection; and completion of policies and laws to ensure the benefits of people who are directly contracted for forest protection.
By the end of August 2017, the supervisory activities were completed in 8 of the 9 provinces as planned. The results of supervisions will become the basis for conducting conferences and forums for the final results to be submitted to the Ethnic Council and the National Assembly. These activities are expected to provide a source of practical information to help National Assembly members discuss and prepare for approval of the revised Draft Law on Forest Protection and Development at the Fourth Session of the National Assembly XIV, which is scheduled in October and November 2017.
